Business fraud and employment contract disputes

One of the most common kinds of business litigation lawsuits involving employment contract disputes is business fraud. At Ridout Barron, for example, we handled cases of business fraud for our clients on a regular basis. Some of the most common types of business fraud claims we see include theft, appropriation of company assets, embezzlement, misrepresentation of products and services and altering of financial documents.

In these kinds of cases, it is very important to gather a firm paper trail of evidence to either defend against or prove the allegations in court. Expert forensic accountants usually need to be called in to analyze the documentation carefully to make one's case. An in-depth legal analysis of the language in an employment contract and other types of contracts will also play an important role because this is a common area of debate in these cases.

One benefit of an employee contract dispute, however, is that they are commonly resolved out of court. Once the facts and evidence have been gathered and shared by both sides, it often becomes clear which party is in the wrong. Following the evidence gathering stage of litigation; therefore, it is usually normal for these cases to reach an out-of-court settlement that is agreeable to both sides.

Because settlement negotiations play such an important part of business litigation disputes, it is important to have legal representation that can be either diplomatic or hard-handed when necessary. Indeed, the perfect mix of patience, friendliness, aggressive representation and strategy is required to successfully navigate any kind of business dispute. When millions of dollars are often on the line, businesses cannot afford to take these matters lightly.
