A woman from Calgary went to Canadian Tire and while she was there, a hot dog stand’s umbrella fell over. The umbrella hit the woman unexpectedly, and a lawsuit she has just filed says that she suffered numerous injuries all over her body, from her head to her hands and feet. It also claims she is dealing with dizziness, memory loss, anxiety, depression, nervousness, a concussion and chronic migraines.
Because of her injuries, the woman is now asking for $570,000 in a lawsuit. The incident in question happened back on May 12, 2013.
The woman says that the hot dog company and Canadian Tire are both responsible for her injuries because a duty of care was owed directly to her, and she should have been safe while she was at the store. Since she was injured, she says that duty of care was breached, thereby making the two companies liable for her injuries.
The money from the lawsuit is split between the woman and her partner, a man who was with her when it happened. She is asking for $450,000 for herself. The additional $120,000 is for her partner.
However, reports did not say what injuries her partner suffered from or if he was struck by the umbrella stand as well.
So far, Canadian Tire and the hot dog company — Supreme Hot Dogs — have not filed any responses to the lawsuit.
When you go to any business, you do have a right to be in a safe environment, and you should expect the business owners to do all that they can to keep you safe. When this doesn’t happen, you may be able to seek compensation.
